Eviction Cleanouts in Ontario: Know the Legal Timeline First
- Only the Sheriff can enforce an eviction. A landlord cannot legally remove a tenant or their property without an LTB order enforced by the Court Enforcement Office (the Sheriff).
- The 72-hour rule. After the Sheriff enforces the eviction, the tenant generally has a short window (often 72 hours) to retrieve their belongings before the landlord may dispose of them. Items left after that window typically become the landlord's responsibility to clear.
- Document everything first. Before anything is moved, take photos and video and create an inventory of what was left behind. This protects you in any LTB or small-claims dispute.
- Cost recovery is possible. Reasonable disposal and storage costs can often be pursued against the former tenant through the last month's rent deposit, where applicable, or via small claims court provided you have documentation.
